Medessec License

The Medessec License was a basic license devised by the Medessec Organization in 2008 as a license for the free software and media the Medessec Organization offered for download.

Because of an incident with the Medessec Gallery in 2007, it was decided that because there were no terms or restrictions on the media that could be downloaded from the Medessec Gallery, a proper terms of use and license had to be made. The first license, devised in early 2008, was very bare and covered very few points. Another license was made later in the year, to help fix issues with the first license. This ended up being the main license and terms to be used until 2010, when the license was reorganized and expanded to help keep the license clear and thorough.

The License

The Medessec License is as follows:

1. You will not redistribute the file and any of its contents in any way (for example, repost the .zip or install file up for download on your website or a different website, such as a forum or blog). This also includes sending the file to others via email or IM. You may, however, provide a link to the download.

2. You may write the files to a CD, Floppy Drive, or other removable volume(such as a flash drive) and you may insert the removable media into other computers to run with that computer. However, you may not directly transfer the files from one computer's Hard Drive to another, i.e, dragging the files from your flash drive to the other computer. This is a direct violation of #1.

3. You will not modify the file, or anything in it, in any way. This includes the use of resource editors, hex editors, trainers and rippers. You may not modify the values or scripts in the file in any way, or rip or replace any of the file's resources(such as sprites, icons, music, and other media) for any purpose.

4. By downloading these files, you acknowledge that the file is free of charge and has no warranty, and assume all risks taken when using it. You agree that the Medessec Organization is not responsible for any system instability, loss of data, crashing, corruption or any other possible damage of sort to your system. We also are not responsible for any physical damage or injury to people or persons when using this software(i.e, seizures, photosensitivity).

5. Also by downloading this software, you agree that Medessec and the Medessec Organization are the sole creator and maker of the file and that you may not take credit for making the file in any way.

6. You also agree that these terms can change at any time and that any of these terms can be lifted from a user if permissible by Medessec.

Points

Point #1

This point covers illegal redistribution of the free file, which separates Medessec products from public domain freeware. It basically means that you cannot repost any Medessec files up for download on any other website. This point was devised after a fan posted a Medessec RCT2 download on Mediafire, and linked it to his YouTube channel.

Point #2

This point expands on #1, but clarifies the users' right to use or run Medessec products from removable media such as CDs and Flash Drives on other computers, provided they don't copy the files from the removable media onto the computer's hard drive. This allows for users to use the Medessec software, especially portable executables, in convenience by going from computer to computer and running the file from a removable device or medium.

Point #3

This point covers any hacking or ripping of any Medessec files, particularly executables, or software. Hacking is a common way many can see the inner workings of the program, such as runtime scripts, values, and even change these things to alter the way the software acts while it runs. This is mainly to help preserve the fitting and suitable appearance and stability while the program runs. It also keeps users from ripping resources from the files, such as music and sprites. This point also applies to the hacking and modifying of image, music, and data files, such as game add-ons.

Point #4

This point is to relieve the Medessec Organization of any responsibility of any type of users inconvenience, as well as securing the fact that the software is free and that if the user is dissatisfied with the software he doesn't have to use it. Despite this point's inclusion in the license, the Medessec Organization does try their hardest to make sure all of their products give the user a satisfactory experience.

Point #5

This point protects Medessec products from copyright infringement, or people stealing ideas or concepts.

Point #6

This point informs users that the license is subject to change, and if it does change, that users will be subject to any changed terms, regardless of whether or not they had actually read them. Most major changes of the license will be posted on the website to ensure that users remain up to date with the license terms.
