Wiki:Copyrights

In addition to being covered by the Terms of Service for Ginever Entertainment online services [1], all contributions to the Ginever Entertainment Wiki are subject to the Ginever Entertainment Wiki Terms of Use. The purpose of these terms is to protect Ginever Entertainment by ensuring that full control is retained over the intellectual property used within Ginever Entertainment projects, while simultaneously avoiding any liability that may otherwise have been created by people submitting unwelcome content.

Please be aware that all contributions to the wiki are expected to meet one of the following criteria:

  • They are original works by you, or works you have derived from other contributions on the Ginever Entertainment Wiki
  • They are copied from a public domain or similar free resource
  • They are works of Ginever Entertainment and your submission of those works to this wiki is covered under fair use laws

In addition, the contributions are covered under the latest approved version of the Ginever Entertainment Wiki Terms of Use only. This means that if the terms which cover contributions to this wiki are changed, and the operator has approved those changes, the new terms will immediately apply to all contributions made either by you or by other people, regardless of when those contributions were made.

By making a submission to the wiki, or by accessing its content, you permanently bind yourself to these terms. If you do not agree to these terms and to the retroactive application of newer versions of the terms, you should not submit any contributions to the Ginever Entertainment Wiki and you should not use, modify or share any contributions that have already been submitted.

The TLDR version (this is not a legal text):

  • We hold all rights to anything that you submit to the wiki
  • You can use anything submitted to the wiki for your own personal use (e.g. using stats or info about a game to formulate a gameplay strategy) but you can't use it for commercial purposes
  • Anything submitted to the wiki must stay on the wiki. You cannot redistribute or share it elsewhere (e.g. copying it to Wikipedia, quoting it on a blog or news article, etc) unless that redistribution is covered under fair use laws
  • You can make changes to anything on the wiki, as long as those changes are being submitted back to the wiki
  • If you're working on "customized software materials" (i.e. mods) for a Ginever Entertainment game, you're allowed to take stuff from the wiki and include it
  • Your contributions must not be harmful to Tinytimrob or to Ginever Entertainment

Ginever Entertainment Wiki Terms of Use

1. PREAMBLE

For the purposes of these terms:

The term "operator" refers to Robert James Dennington of 60 Halesworth Road, WV9 5PJ, United Kingdom.

The term "Ginever" refers to an unincorporated association based in the United Kingdom at the same address which is managed by the operator.

The term "contribution" refers to any form of code, patch, tool, utility, artwork, audio, level, scene, prefab, animation, documentation, manual, specification, concept, idea or any other material which is submitted, posted, uploaded or transferred by you to the Ginever Entertainment Wiki.

2. GRANT OF RIGHTS BY CONTRIBUTORS

If you are registered with GineverAccount and your account is not blocked from accessing the service, you are hereby permitted to submit contributions to the Ginever Entertainment Wiki, subject to the limitations in section 4. For all submissions made by you (regardless of whether they are permitted or not), the following grant of rights applies:

(a) With respect to any worldwide copyrights, trademarks or copyright and trademark applications and registrations that cover your contributions, you assign to the operator all right, title and interest worldwide in those copyrights and trademarks.

(b) To the extent that any of the rights in section 2(a) cannot be assigned by you to the operator, you grant to the operator a perpetual, worldwide, exclusive, royalty-free, transferable, irrevocable license under such non-assigned rights, with rights to sublicense through multiple tiers of sublicensees, to practice such non-assigned rights, including, but not limited to, the right to reproduce, modify, display, perform and distribute your contributions.

(c) To the extent that any of the rights in section 2(a) can neither be assigned nor licensed by you to the operator, you irrevocably waive and agree never to assert such rights against the operator, Ginever or any of its successors in interest, or any legal entity which the operator chooses to grant license or sublicense to for your contributions.

(d) For patent claims including, without limitation, method, process, and apparatus claims which you own, control or have the right to grant, now or in the future, you grant to the operator a perpetual, worldwide, non-exclusive, transferable, royalty-free, irrevocable patent license, with the right to sublicense these rights to multiple tiers of sublicensees, to make, have made, use, sell, offer for sale, import and otherwise transfer your contributions and the projects where your contributions are used. This license is granted only to the extent that the exercise of the licensed rights infringes such patent claims.

3. USE, MODIFICATION AND REDISTRIBUTION OF CONTRIBUTIONS

For all contributions submitted to this wiki, the following applies:

(a) You are permitted to use the contributions for personal, non-commercial use, subject to the limitations in section 4.

(b) You are permitted to modify the contributions for the purposes of submitting those modifications to the Ginever Entertainment Wiki, subject to the limitations in section 4.

(c) You are permitted to use, modify and redistribute the contributions as part of "customized software materials" for software products which are developed or published by Ginever Entertainment which authorize you to create "customized software materials" under their respective license terms, subject to the limitations in section 4.

(d) Any usage, modification or redistribution of the contributions not permitted under this section of the terms is prohibited.

4. LIMITATIONS

Your usage, modification, submission and redistribution of the contributions must not result in harm or damage to the operator in any way, either directly or indirectly. It is up to the discretion of the operator as to what constitutes harm or damage.

5. NO WARRANTY

The contributions are provided "as is", without warranty of any kind, expressed or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose and non-infringement. In no event shall the authors or copyright holders be liable for any claim, damages or other liability, whether in an action of contract, tort or otherwise, arising from, out of or in connection with the contributions, or the use of other dealings in the contributions.

The views and conclusions contained in the contributions are those of the authors and should not be interpreted as representing official policies, either expressed or implied, of the operator or of Ginever Entertainment.
